Description
Mediation involves the engagement, whether by party agreement or (if permissible) by prescription of law or court order, of one (or more) independent neutral(s) (“the mediator(s)”) actively to support and assist confidential negotiations between the parties to a dispute in their attempt to reach voluntary agreement on the settlement of all (or some) of the issues between those parties. The mediator does not have authority to impose a solution on the parties to the dispute, nor the power to evaluate or advise on the merits or determine the outcome of any dispute. For the avoidance of doubt, Mediation Activities as defined in this Code excludes: • provision of legal advice, • drafting legal documents or opinions (other than supporting and assisting the parties to draft their own mediation settlement agreement), • negotiation of legal rights or responsibilities. A company undertaking Mediation Activities within this Code is not a “company service provider” within Code 7025
